Over a dozen US cities have decriminalized psilocybin — meaning possession is the lowest law enforcement priority. Decriminalization is always step one. Full legalization follows.

What decriminalization actually means

Decriminalization is not the same as legalization. It means local law enforcement has been directed to make psilocybin possession their lowest priority — effectively, they won't arrest you for personal use. But there is no commercial framework. You cannot legally sell, operate a service center, or advertise a psilocybin business in a decriminalized city (unless the state has also legalized, as in Colorado).

What decriminalization does mean for entrepreneurs: it signals political will, it builds community awareness and demand, and it is almost always followed within a few years by a state-level legalization push. This is the cannabis playbook, step for step.

The pattern: City decriminalizes → more cities follow → state ballot measure → state legalization → commercial framework. Denver decriminalized in 2019. Colorado legalized statewide in 2022. That's three years.

2019 — First in the US
Denver, Colorado

Initiative 301 passed with 51% of the vote. Made personal possession and use of psilocybin mushrooms the lowest law enforcement priority. Now covered under Colorado's full state legalization.

2020
Oakland, California

City Council unanimously decriminalized all entheogenic plants and fungi, including psilocybin. One of the broadest decrim policies in the country. California state legalization efforts are ongoing.

Ann Arbor, Michigan

City Council resolution making enforcement of entheogenic plant laws the lowest priority. Ann Arbor has a long history of progressive drug policy — it was also one of the first cities to decriminalize cannabis in the 1970s.

Washington, DC

Initiative 81 passed with 76% of the vote — an overwhelming mandate. Made entheogenic plants and fungi lowest enforcement priority. A "gifting" gray market has emerged. Federal jurisdiction complicates full legalization.

Santa Cruz, California

City Council resolution decriminalizing personal use and possession of entheogenic plants including psilocybin mushrooms.

Somerville, Massachusetts

City Council decriminalized entheogenic plants. Boston followed shortly after. Massachusetts is considered a strong candidate for state legalization within the next 2-3 years.
